DA reports suspected nepotism at Levai Mbata clinic in Emfuleni to Public Protector

The Democratic Alliance (DA) in Gauteng has submitted a formal complaint requesting that the Public Protector urgently investigate allegations of nepotism and conflicts of interest surrounding the recruitment process for a pavement construction contract at Levai Mbatha Clinic CHC in the Emfuleni Local Municipality (ELM).

The main contract for paving works at Levai Mbatha Clinic CHC was awarded to Mox Trading, which acted as the principal service provider. Mox Trading subcontracted portions of the work to Lithole Trading and Starish and Monotsi Construction. An additional concern involves the employment of individuals related to a senior municipal official. Two workers on this project, Mr Bushy Masangane and Mr Katleho Masangane, are reportedly the husband and son of Councillor Sibongile Soxuza, who serves as the Speaker of the Emfuleni Local Municipality.

The DA suspects potential conflicts of interest and acts of nepotism that may have compromised the fairness and integrity of the awarding and execution of this contract. Cllr Soxuza, as Speaker, occupies a senior leadership position with oversight over municipal governance and council decisions. The employment of her relatives on a municipally funded project creates a conflict of interest under Section 5(1) of the Municipal Systems Act, which prohibits councillors from benefiting themselves or family members. Furthermore, the involvement of the Speaker’s family members strongly suggests nepotism.

The DA requests the Public Protector to investigate whether Cllr Sibongile Soxuza declared her family relationship with project employees and recused herself from any related decisions; review payroll and appointment records to confirm the roles and remuneration of Bushy and Katleho Masangane; and recommend disciplinary action.

It is concerning that Gauteng Health MEC Nomantu Nkomo-Ralehoko has not addressed our concerns regarding the handling of the Levai Mbatha pavement contract, despite our submission of a memorandum demanding an internal investigation. Equally troubling is Premier Panyaza Lesufi’s continued silence and apparent disinterest in these serious allegations, despite the long history of corruption and mismanagement within this department.

A DA-led Gauteng Provincial Government would ensure that tenders are awarded fairly and transparently, giving equal opportunities for every local business, not only those with political connections. We would eliminate nepotism to ensure all residents benefit from community projects.
